TERMS AND CONDITIONS OF SERVICELast Updated: February 20261. INTRODUCTION
1.1. These Terms and Conditions ("Terms") govern the relationship between Trade Watch Alerts ("we", "us", "our") and the subscriber ("you", "the Client").
1.2. By subscribing to our service, you agree to be bound by these Terms. If you do not agree, please do not purchase the service.
1.3. Trade Watch Alerts is a data intelligence service providing compiled public planning information. We are not a lead generation agency in the traditional sense, nor are we a construction broker.
2. SERVICE DESCRIPTION
2.1. The Service: We provide a weekly email containing a CSV file comprising data scraped from UK Local Council planning portals.
2.2. Data Content: The data may include planning application numbers, development addresses, descriptions of work, applicant names (homeowners), and agent contact details (architects/planning consultants) where publicly available.
2.3. Technology: The service utilizes AI-assisted scraping and human verification. While we strive for accuracy, we do not guarantee that all data fields (particularly phone numbers) will be populated for every lead.
2.4. Delivery: Data is delivered weekly via email. Delivery times may vary depending on Council publication schedules.
3. SUBSCRIPTION AND PAYMENT
3.1. Fees: The subscription fee is £49.99 + VAT per month (unless otherwise stated).
3.2. Billing: Payments are taken in advance on a monthly rolling basis via Stripe/PayPal.
3.3. VAT: All prices are exclusive of VAT unless stated otherwise. VAT will be added at the prevailing rate if applicable.
3.4. Cancellation: You may cancel your subscription at any time. Access to the service will continue until the end of the current billing period. No refunds are provided for partial months.
3.5. Price Changes: We reserve the right to adjust subscription fees for new customers. Existing subscribers will be given 30 days' notice of any price increase.
4. EXCLUSIVITY MODEL
4.1. Territory: We operate an exclusivity model where only one client per trade category (e.g., Builder, Electrician) per Council District is accepted.
4.2. Availability: Exclusivity is subject to availability. Once a territory is filled, subsequent applicants will be placed on a waiting list.
4.3. Loss of Exclusivity: If a subscription is cancelled or lapses, the exclusivity rights for that territory are immediately forfeited and may be sold to another client.
4.4. No Volume Guarantee: Exclusivity guarantees you are the only subscriber receiving the data for your area; it does not guarantee a specific volume of leads per week. Planning application volumes fluctuate based on Council activity.
5. DATA USAGE AND COMPLIANCE (CRITICAL)
5.1. Public Record: You acknowledge that the data provided is sourced from public records. However, the use of this data for marketing purposes is regulated by UK law.
5.2. Client Responsibility: You are solely responsible for ensuring your use of the data complies with all applicable laws, including but not limited to:

TPS (Telephone Preference Service)
5.3. Contact Methods:
Agent Details: Contact details for Planning Agents/Architects are provided for B2B communication.
Homeowner Details: Homeowner names and addresses are provided for legitimate business interest. You must not cold call homeowner mobile numbers unless you have verified consent or checked against the TPS register. We recommend direct mail (postal) as the primary initial contact method for homeowners.
5.4. Indemnity: You agree to indemnify and hold harmless Trade Watch Alerts from any claims, fines, penalties, or legal fees arising from your use of the data. If you are fined by the ICO (Information Commissioner's Office) or any other body due to your outreach methods, Trade Watch Alerts accepts no liability.
5.5. Prohibited Use: You may not resell, redistribute, or share the data with third parties. The license is for your internal business use only.
6. ACCURACY AND LIABILITY
6.1. "As Is" Basis: The service is provided on an "as is" basis. While we perform human verification, we do not guarantee that all phone numbers are active, all projects are proceeding, or all details are error-free.
6.2. No Conversion Guarantee: We provide intelligence data, not guaranteed sales. We make no representations regarding your ability to secure contracts or profit from the leads.
6.3. Limitation of Liability: To the fullest extent permitted by law, Trade Watch Alerts' total liability to you for any claim shall not exceed the total subscription fees paid by you in the three (3) months preceding the claim.
6.4. Service Interruption: We are not liable for delays or failures in performance resulting from acts beyond our reasonable control, including Council website changes, server outages, or internet failures.
7. INTELLECTUAL PROPERTY
7.1. Ownership: While the source data is public, the compilation, formatting, and verification of the data are the intellectual property of Trade Watch Alerts.
7.2. License: You are granted a non-exclusive, non-transferable license to use the data for the duration of your subscription.
8. TERMINATION
8.1. Breach: We reserve the right to suspend or terminate your subscription immediately if we believe you are using the data in a manner that violates UK law (e.g., harassment, spamming) or breaches these Terms.
8.2. Effect of Termination: Upon termination, you must cease all use of the data and destroy any copies in your possession.
9. GOVERNING LAW
9.1. These Terms shall be governed by and construed in accordance with the laws of England and Wales.
9.2. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
